Buyer's right to cancel: You may cancel this agreement by delivering written notice to SmartTech Windows & Doors within 10 calendar days of the date shown above.
All measurements shown are preliminary; final on-site measurements will supersede.
Prices in Canadian dollars and include applicable taxes. Deposit applied at signing or after final measurements per section noted above.

WARRANTY
Transferable and Non-Prorated
- The U.P.V.C. window frames & sash are warranted against defects in materials such as blistering, peeling, flaking, corroding or fading for a period of lifetime (25 years) from the date of installation.
- All HARDWARE is warranted against defects in material for a period of lifetime (25 years) from the date of installation.
- Insulating glass units are warranted for a period of lifetime (25 years) against seal failure. Glass breakage of any kind is not covered by this warranty.
- Sliding patio door U.P.V.C. frame & sash are warranted for a period of lifetime (25 years) against blistering, flaking, corroding, discoloring and peeling.
- Steel doors, door lites and other components are covered by a 15 year warranty against defects in materials such as delamination of the slabs, blistering or peeling. SmartTech Windows and Doors Inc. shall not be liable for any consequential or incidental damages.
- This warranty will be void if units are not installed in accordance with our instruction or are damaged in installation.
- This warranty does not cover damage of any kind caused by misuse, abuse, negligence, fire or acts of God.
- Workmanship of all SmartTech Windows and Doors Inc. products warranted for a period of lifetime from date of manufacture.
CONDITIONS
IT IS AGREED BETWEEN THE PARTIES
- The title to the said articles shall remain with the Seller, at the Purchaser's risk, until full payment of the purchase price and interest, as herein provided, and all monies due hereunder or any renewals or extensions thereof, or of said note or order, any Judgment recovered in respect of said note or contract shall have been paid.
- All balances are due upon substantial performance under this contract (unless otherwise stated). If additional service is required, the purchaser(s) agrees to pay a minimum of 90% of the balance owing.
- Delivery and installation is to be made as soon as possible and the Seller shall not be liable for failure to perform this agreement in whole or in part, if prevented by acts of God, strikes, boycotts, unavoidable accidents, embargoes, shortage of labour, emergency regulations or other causes beyond its control.
- No work or alterations are to be done on the property unless specified and listed on this contract.
- The said goods shall be and shall remain personal or moveable property and shall not be deemed part of the realty, even though affixed or attached thereto, and whether or not placed upon a permanent foundation.
- Acceptance by the Seller of any renewal or collateral notes or the recovery of any Judgment against the purchaser shall in no way affect the rights of the Seller to repossession and take of the articles and loss or destruction of the articles shall not release the Purchaser from payment in full.
- Time is of the essence of this agreement. Should the Purchaser make default in payment hereunder, or violate any of its terms, or become bankrupt or insolvent, or sell or dispose of the said articles contrary to the provisions of this agreement, all installments shall immediately become due and payable, and the Seller may forthwith take possession of the articles, and any accessories added thereto, without legal proceedings, and for such purpose may enter any premises without notice and shall not be responsible for any damage caused thereby.
- The Seller may keep the said articles and retain all monies paid on account thereof as liquidated damages and not as penalty, or may sell same at public or private sale, at auction, if any, to be paid to the Purchaser, and in case of deficiency, the Purchaser shall be liable to pay such deficiency.
- The Purchaser shall be liable for all costs of collection and other charges necessary as a result of default in payment.
- All warranties, conditions and guarantees expressed or implied for the products herein sold are set out in the within contract and the other parties by their signatures hereto specifically exclude the provisions of the Sale of Goods Act, R.S.O. 1980 and amendments and any other Provincial or Dominion Statutes which can be excluded from the within contract and this clause may be pleaded as an estoppel by the Vendor.
- SmartTech Windows and Doors Inc. will not be held responsible for reconnecting existing security alarm systems or any charges that may incur from the customer's security provider.
- SmartTech Windows and Doors Inc. will not be responsible for the following preparations of work areas, including the removal of blinds, drapes, furniture, security alarms, covering furniture, closing snow and anything else applicable. For safety reasons, anyone present on site must maintain a safe distance of at least 10 feet from all ongoing work.
- The Purchaser must pay the full balance amount as stated in the agreement before any services, work, scheduling, inspections, or issue resolutions will be provided. No claims, concerns, or service requests will be accepted or processed until the full balance has been received by the Seller.
You may cancel this contract from the day you enter into the contract until 10 days after you receive a copy of the contract. You do not need a reason to cancel.
If you cancel the contract, the seller has 15 days to refund your money and any trade-in, or the cash value of the trade-in. You must then return the goods.
Changes in temperature and high humidity in the house is the natural result of moisture and may cause temporary surface condensation. It does not indicate a defective window. To prevent this, you should provide a reasonable ventilation and air circulation in the house.
Performance conforms to standard in accordance with CAN-CSA-A440-M98 and should meet with AAMA evaluation.
